PBNU to propose judicial review on omnibus law
Central Board of Nahdlatul Ulama (PBNU) stated that they support the proposal of the judicial review of the omnibus law on job creation to the Constitutional Court (MK). The chairman of PBNU, Said Aqil Siradj, stated on Friday that PBNU supports those who seek justice against the omnibus law through the judicial review to the MK. Moreover, Said reminded people of refraining from their urge to protest in order to prevent the mass infection of the novel coronavirus disease (COVID-19). Said added that legal measure is the best and most appropriate way to seek justice.
Said said that NU is also against the omnibus law on job creation ratified by the House of Representatives (DPR) on Monday, as it seems to harm the people in need and benefit the capitalists. PBNU highlighted chapter 26 K in the law that stated educational institutions as a business entity. Said asserted that education institution is not a business entity, and the chapter could open a chance for other irresponsible parties to retort education institution commercially. Then, Said also highlighted the work agreement system, a problem faced by the workers against the omnibus law.
The PBNU chairman also mentioned the halal certification. The 48th chapter of the omnibus law has revised several provisions in UU No. 33 of 2014 regarding Halal Products Guarantee. Said saw it as centralization and monopoly of fact for one entity amid the growing sharia enthusiasm could cause an overwhelming impact for the succession of the halal certification program. Moreover, Said stated that the omnibus law further bolsters the industry bias paradigms toward halal certification because the assessor - according to the 14th chapter - should be a bachelor in food chemistry, biochemistry, engineering, biology, pharmacy, medical, culinary, or agriculture.
Therefore, Said asked people to act firmly against the omnibus law on job creation, as the rights of the people should be prioritized.
