Federal Court Denied Trump’s Restricting Asylum Seekers Policy

President Donald Trump’s effort to restrict asylum seekers is once again can’t be approved by the federal court. On Friday, August 2, U.S. District Judge Randolph Moss denied Trump’s proposed policy that will reject asylum from migrants who entered the country between legal entry ports. Judge Moss went further to mention that Trump’s policy violated immigration law. The proposed rule from President Donald Trump has been seen as an inconsistency to the Immigration and Nationality Act, which is the 1952 act. Therefore, Judge Moss couldn’t accept the rule to be applied.

The controversial policy about restricting migrants from seeking asylum in U.S. already being issued since his proclamation in November 2018. So, before the rejection on Friday, President Trump already received the blocking from his first proposal on July 24. The U.S. District Judge was Jon Tigar. He rejected Trump’s policy based on evidences about migrants who can’t be safe waiting for asylum in Mexico, instead of going to the U.S. Judge Tigar had made clear that Trump’s administration didn’t provide the right solution by the proposed policy. After all, the humanity still needs to be preserved by acknowledging the importance of migrants’ lives.

The second rejection of Trump’s policy is celebrated by immigrant rights advocates. Keren Zwick of the National Immigrant Justice Center stated that it will makes things easier for the bona fide refugees, who would have otherwise been denied the right to seek asylum. The rejection of the policy also gives hope to prevent any further attack for asylum seekers. Meanwhile, the U.S. Justice Department is still not responding to the request for a comment.
