Sri Mulyani: The new Perppu doesn't render officials immune

Indonesia’s Minister of Finance, Sri Mulyani Indrawati, asserted that the legal protection is written in the Regulation in Lieu of Acts (Perppu) No. 1 of 2020 regarding State Finance and Financial System Stability for COVID-19 Management does not give absolute legal immunity for the government officials.

Previously, the legal protection is regulated in Article 27 of Perppu No. 1 of 2020.

Speaking on Wednesday, Sri Mulyani explained that the second paragraph declared KSSK’s members, secretary, to the officials of the Finance Ministry, Bank Indonesia (BI), Financial Service Authority (OJK), and Deposit Insurance Agency (LPS), and other government officials cannot be sued under civil nor criminal codes as long as their conduct follows goodwill and is in accordance with the Indonesian Laws.

The third paragraph also said that all actions including decisions taken according to Perppu cannot be brought to the state administrative court.

For the former Managing Director of the World Bank, the legal protection is bestowed to give legal certainty and justice for the executor of Perppu No. 1 of 2020, as long as they do their duties in accordance to the laws. She also reminded that the Perppu was signed in the event of force majeure, the outbreak of the novel coronavirus disease (COVID-19) in Indonesia.
